Mechanics Liens

Mechanics Liens Lawyer Pasadena

Have You Been Cheated on a Subcontracting Job?

Everyone who is involved in construction or remodeling has a special interest in the project. The general contractor is responsible for hiring and paying subcontractors, and making sure the project steps are completed on time. Problems can arise if the general contractor receives payment from the homeowner and does not pay the subcontractors. The homeowner, in turn, may receive a mechanics lien from a subcontractor, which means the homeowner would be paying for the same work twice.

Attorney Leon A. Victor has 20 years of experience representing contractors, subcontractors and homeowners in contract disputes and construction law matters. We understand that you have done the work and want to get paid as painlessly and quickly as possible. Our goal is to provide smart, cost-effective counsel.

Free consultation

We offer every construction lien client a free initial consultation. If you believe you may have difficulty collecting the funds owed you, we recommend you retain an experienced mechanics lien attorney to provide counsel. Contact our Pasadena, California, law office or call 626-792-4255.

When you file a mechanics lien, you are placing a lien or hold against the homeowner's property. The family understandably is reluctant to have their homeowner's property sold at a sheriff's auction, so they will fight hard to protect their interests. It is also possible to file a stop notice, which places a lien against construction funds.

Work that is covered by a mechanics lien

Mechanics liens cover the following type of work by subcontractors, suppliers and vendors:

  • Equipment leases for the project
  • Supplies and materials, including appliances
  • Labor performed by licensed subcontractors and their crew

The procedural steps in filing a mechanics lien are fairly straightforward. First the Preliminary Notice is filed to the owner, lender and contractor that the money is owed. During this time, we can still sue for breach of contract. After the lien is recorded, you have 90 days to file a lawsuit or perfect the lien. If a judgment is issued, the property may be ordered sold in order to pay the lien.

Representing the interests of homeowners

If a subcontractor has filed a mechanics lien against you as a homeowner, a lawyer at the offices of Leon A. Victor & Associates, PC, in Pasadena, can advise you how to deal with the situation. We also advise homeowners how to protect themselves before beginning a construction or remodeling project. We can provide counsel on how to file a Notice of Commencement and a Notice of Completion, and how to get a Release of Lien as you pay for remodeling work.

Filing a lien is very serious business, and requires skilled, experienced counsel for a favorable outcome. We offer free consultations.
